Medical Malpractice

5/5

Pikeville Medical Malpratice Attorney

We put our trust in doctors to give us the treatment we need. But sometimes mistakes and failures are made. These mistakes and failures may result in unnecessary injury, sickness or even death.

This is known as medical malpractice. When it occurs, you or a loved one is usually entitled to seek compensation by filing a medical malpractice lawsuit. A medical malpractice attorney can help you to file this legal claim – this can increase the chance of you receiving the compensation you deserve.

What counts as medical malpractice?

Medical malpractice can include a lot of things. Some examples of medical malpractice include:

  • Surgical errors
  • Unnecessary surgery
  • Childbirth injuries
  • Misdiagnosis of health problems
  • Delayed diagnosis/treatment
  • Medication prescription errors
  • Anesthesia errors
  • Premature discharge
  • Hospital infections

There are many other situations that may be classed as medical malpractice. Generally speaking, if a healthcare professional has acted negligently and it has had a negative impact on your health, it can be classed as medical malpractice and you can seek out compensation.

Why file a medical malpractice claim?

A medical malpractice claim could be a chance to receive financial compensation. Money cannot always make up for the damage inflicted, however in many cases it can definitely help to improve quality of life. It may allow you to afford treatment to correct any health problems caused as a result. Alternatively, it may help you to pay off any medical debts from the treatment. It is up to you how you spend it.

Medical malpractice claims can also be about more than just money. It’s a chance to hold any medical staff accountable for the negligence that you have experienced. Making a legal claim can often ensure that the same mistake doesn’t happen twice – it can highlight the seriousness of the incident and can force medical professionals to take steps to prevent any other patients being harmed.

Why hire a medical malpractice attorney?

Filing a lawsuit without a lawyer is not easy. There are a lot of steps required and you may find that you are met with opposition in some cases. This is why it is often worthwhile hiring a medical malpractice attorney to help you through the process.

A medical malpractice attorney will first be able to determine whether you have a claim. Certain cases are not black and white, and so it can be worth getting a professional opinion so that you’re not wasting your time on a claim that’s likely to be rejected. .

If you’re eligible to make a claim, an attorney can then help you to gather evidence for your case, identify who is liable, question any expert witnesses and also help you decide the value of the compensation you are owed. All of this is important when it comes to increasing the chance of your claim being successful.

Attorneys can also help with the process of filing the claim. If your case needs to be taken to court, attorneys can also help to support you through any court proceedings. It’s worth hiring an attorney early – the later you leave it in the process, the harder it will be to pick up the pieces.

How long do I have to file a medical malpractice lawsuit?

In the state of Kentucky, medical malpractice lawsuits must be filed within one year of the accident or error. After this time, most malpractice claims will generally not be considered.

This is why you shouldn’t wait too long to hire a Pikeville medical malpractice attorney – fail to act fast, and it may be too late to file a claim.
