Pikeville Workers Compensation Attorney

Every year, many workers are injured or made sick as a result of their work. This may result in the need for expensive treatment. You may also need to take time off work to recover (in severe cases, you may not even be able to return to work), which could result in you no longer receiving an income.

Fortunately, in these situations you are likely to be eligible to make a worker’s compensation claim. This allows you to receive a financial payout, which can help to go towards your treatment and recovery.

While the process of filing a claim can be fairly straightforward, it can still be worth hiring a Pikeville workers comp attorney in order to make sure that you get the right level of compensation. Hiring a workers comp attorney could be particularly important if you think an employer or their insurance company is likely to reject your claim and that you may need to fight your case.

What are some examples of common worker’s compensation claims?

Worker’s compensation claims can be filed for all kinds of injuries. A few of the common incidents that lead to worker’s compensation claims include:

  • Slips and falls
  • Road accidents
  • Machinery accidents
  • Overexertion
  • Burn injuries
  • Injuries from falling objects
  • Exposure to harmful chemicals/substances

If you have sustained any of these types of injuries, it is worth making a claim. If you are unsure whether an injury makes you eligible for worker’s compensation, it could be worth talking to an attorney who will be able to assess your injury and help you determine whether you have a case.

How do you file a worker’s comp claim?

In order to file a workers’ comp claim, you will first need to notify your employer. In most cases, your employer will file the claim to their insurer for you. The insurance company will then approve or reject your claim based on the evidence that has been submitted.

It is important that you file your claim as soon after the accident as possible. If you wait too long, you may not be able to make a claim as many insurers have time limits in place following an accident, after which they will not consider your claim.

If your employer’s insurance company rejects your claim, a worker’s comp attorney can help to fight your case. A worker’s comp attorney can also fight your corner if your employer is refusing to file a claim. All in all, it is good to have a worker’s comp attorney on your side.
